These terms of use (“Terms of Use”) set forth the basis on which you are permitted to access and use the "IsraelBibleCenter.com" website, including any content, functionality, and services offered on or through "IsraelBibleCenter.com" (the "Website" and/or the “Services”). Please read the terms of use carefully before using "IsraelBibleCenter.com". BY USING the Service, YOU ARE AGREEING TO ABIDE BY THESE TERMS OF USE AND ANY MODIFICATIONS THERETO. If you do not want to agree to these Terms of Use, you must not access or use the Website or Services.

USE OF WEBSITE AND SERVICES

This site is owned and operated by ISRAEL BIBLE INSTITUTE ("the Owner"). The site is protected, without limitation, pursuant to U.S. and international copyright, trademark patent, trade secret, and other intellectual property or proprietary rights laws. These Terms of Use permit you to use the Website for your personal, non-commercial purposes only. No material from the Website may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or modified except in the following cases:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print (or download) one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution, provided that you keep intact all copyright and other proprietary notices.
• You may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided that you agree to be bound by our end user license agreement for such applications.

You must not:

• Modify copies of any materials from this site.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site.
• Access or use for any commercial purposes any part of the Website or any services or materials available through the Website.

Modification of the materials or use of the materials for any other purpose is a violation of ISRAEL BIBLE INSTITUTE/ISRAEL BIBLE CENTER's copyright, trademark, and trade secret rights and others' proprietary rights. For purposes of this Agreement, the use of any such material on any other website or networked computer environment is prohibited. The violation of applicable intellectual property laws may give rise to civil and/or criminal penalties. In the event that you download software from the site, the software, including any files, images incorporated in or generated by the software and data accompanying the Software (together, the "Software"), are licensed to you by ISRAEL BIBLE INSTITUTE/ISRAEL BIBLE CENTER. The owner does not transfer the title of the Software to you. Owner retains full and complete right, title, and interest in and to the Software, and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse-engineer, or disassemble the Software.

The Owners’ name, terms, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ISRAEL BIBLE INSTITUTE/ISRAEL BIBLE CENTER. You must not use such marks without the prior written permission of ISRAEL BIBLE INSTITUTE/ISRAEL BIBLE CENTER. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

Filling out the registration form constitutes the consent of the registrant that the particulars of registration and any data obtained on the basis of an analysis of these details and any information about the registrant that has reached and/or will reach the company's knowledge will be held in one or more databases of a company or anyone acting on its behalf for the purpose of: 

(A) marketing, advertising, sales promotion, and sales, and for the purpose of applying for registration in any manner, including through direct mail in any media that it deems appropriate (including in writing, print, telephone, text message, facsimile, computerized way, or other means), 

(B) encouraging loyalty, analysis, and statistical research, conducting surveys, and any other online use in connection with a marketing subject, 

(C) internal needs, such as the need to investigate complaints and/or audits; 

(D) mailing marketing and advertising material, including through cookies, such use of the particulars of the registrant shall not be considered an infringement of privacy. 

It is further agreed that such information shall be deemed to be the property of the Company and the registrant hereby waives any claim in respect of the use and/or ownership of such information, including waiver of any claim under the Protection of Privacy Law, 5741-1981. The Company shall not be considered a breach of a privacy undertaking or infringing on user privacy any information, as defined in the Computers Law 5755-1995, which will be used to identify or trace a user by another person, and which derives from the use of electronic means of communication in general and computer communications in particular.

 

REFUNDS

There are no refunds. Instead, follow the cancellation procedure (below).

CANCELLING THE SUBSCRIPTION

If you signed up for a monthly subscription, you can discontinue it at any time. You will retain the full use of the account for the remainder of the purchased days, but the billing will be discontinued right away. To cancel, please sign in to your account and complete the cancellation process in the Student Account in “My Profile” by choosing the "Cancel" tab. If you require special assistance please request it through a form on the CONTACT US page of the IsraelBibleCenter.com website.

If you signed up for a yearly subscription, you can cancel it at any time before the annual renewal date. The yearly plan is substantially discounted with broad privileges because it is a pre-paid yearly plan. You will retain full use of the account for the remainder of the year, but future billing will be discontinued right away. To cancel, please sign in to your account and complete the cancellation process in the Student Account in “My Profile” by choosing the "Cancel" tab. If you require special assistance, please request it through a form on the CONTACT US page of the IsraelBibleCenter.com website.

USER ACCOUNTS

Some functions of the Service may require you to register by selecting a unique user identification ("User ID") and password, and to provide certain information about yourself. You agree to provide accurate, current, and complete information about yourself as prompted, and to maintain and promptly update the information to ensure that it remains accurate, current, and complete. If you provide any information that the Owner believes to be inaccurate, not current, or incomplete, or if you select a User ID that the Owner, in its sole discretion, finds offensive or inappropriate, the Owner reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service.

You agree to:

(a) keep your password confidential and to only log in with your User ID and password, and ensure that others may not access any members-only or password-protected portions of the Service using your account and/or identity; 

(b) exit from your account at the end of each session;

(c) immediately notify the Owner of any unauthorized use of your User ID and/or password. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You are fully responsible for all activities that occur under your User ID. The Owner will not be liable for any loss or damage arising from your failure to comply with this section.

The Owner uses systems and procedures in order to accomplish data protection. Nevertheless, we cannot guarantee complete security protection. Therefore, the Owner does not guarantee that the information, the data and the services on the Service will be absolutely resistant to unauthorized access.

USE OF EMAIL ADDRESS

Some functions of the Service may require you to provide your email address. The Service may use your email address to communicate with you regarding the Service. The Owner may also use your email information to solicit feedback from you or alert you to new features in our products that we think may be of interest. You will always have the option to opt out of such communications. Your email address and other contact information are not used for any other purposes than those related to the Service. The Owner may utilize an external service for sending and tracking email communications and unsubscribe requests. These third parties may not share or use your email address for any other purpose.

INFORMATION AND CONTENT YOU SUBMIT

Any content you submit to the Owner or the Site, through a “contact us” mechanism or otherwise, will be treated as non-confidential and non-proprietary and will not be returned. You agree that the Owner is free to use any ideas or concepts you submit to us for any purposes whatsoever, including, without limitation, developing, manufacturing, and marketing products and services; and creating informational articles, without any payment of any kind to you.

WEBSITE USE ELIGIBILITY

The Service is intended for use by adults and/or children under the supervision of a parent or guardian who has agreed to these Terms of Use. By registering as a user of the Service you represent and warrant that you have the right, authority, and capacity to enter into these Terms of Use and to abide by all of the terms and conditions set forth herein. If you are under the age of 18 or the applicable legal age in your jurisdiction, you can use the Service only in conjunction with your guardian's supervision.

The site permits the use of various tools. The Owner will use his best efforts to assess any possible risks for the Service users in that respect. However, the Owner is under no obligation to oversee, monitor or moderate any interactive service that it provides on the site, and the Owner explicitly denies any liability for any loss or damage arising from the use of any interactive service by the user. In the case of a minor, the responsibility for any use of the Service is solely that of the parent or legal guardian.

Registration for the Service necessitates a subscription, which requires you to provide your name and e-mail address, and may require provision of other information. Information that you provide during registration, as well as certain other information about you, is subject to our Privacy Policy. (f) attack the Website via a denial-of-service attack or a distributed denial-of-service attack;

(h) obtain any materials or information through any means not intentionally made available to you through the standard Owner services;

(i) impersonate or attempt to impersonate the Owner, an employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses [or screen names] associated with any of the foregoing). We have the right to take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website.

The Owner is not responsible is any way for the content of such websites and, furthermore, makes no recommendation or endorsement as to such websites or the products or services offered thereon. The Owner accepts no responsibility for them or for any loss or damage that may arise from your use of them. The Owner places cookies on your computer to retain your individual preferences and improve your user experience with our site and services, as well as to tell us what features of our site, services, or software are most popular. We do not store any personal identification information in cookies, nor do we use cookies to obtain any personal information from you. You can change the configuration of your browser in such a manner that you will not be able to receive any cookies during your use of the Owner's services, software, or website. In that event, your access or use of certain parts of our site, software, or services, may be restricted.

GOVERNING LAW AND JURISDICTION

All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of ISRAEL without giving effect to any choice or conflict of law provision or rule (whether of ISRAEL or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the competent courts of Tel Aviv, Israel. However, we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue in such courts.

LIMITATION ON TIME TO FILE CLAIMS

Any cause of action or claim you may have arising out of or relating to these Terms of Use or the Website must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

WAIVER AND SEVERABILITY

No waiver by the Owner of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Owner to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

CHANGES TO TERMS OF USE

The Owner may periodically update these Terms of Use. The Owner reserves the right to modify or add to these Terms at any time without prior notice ("Updated Terms"). You agree that we may notify you of the Updated Terms by posting them on the Site so that they are accessible via a link on the homepage and that your use of the Site after we have posted the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review these Terms before using the Site.
